Mediation never fails, only the parties to the mediation fail and this happens when there is a refusal to commit to the resolution of the dispute. One of the signs that parties to a dispute are unwilling to commit to the resolution thereof is when they freeze and become unwilling to talk. Unwillingness to talk sometimes is reflected in the parties withholding information that will help in the understanding of the nature and dimensions of the dispute.
